This Terms of Agreement applies between You, our "Service", and our Agreement that binds together.
OUR SERVICE AND HOW IT INVOLVES WITH YOU
You, the "User" or as sometimes called to be the "Member", the one that registered to our Service and the one who agrees to use our Service without limitation, will be involved in our Service operations, such as messaging, posting to threads, creating threads, editing user profiles, and additional actions provided by the Service.
By registering to the Service, you agree that you are 13 years or older, or within the legal age in your country or jurisdiction, to access or otherwise participate in by using our Service. Due to the requirements from the European GDPR, as a requirement since our host is in the UK, you must be 16 years or older in the areas of Europe, Ireland, and Scotland. This includes the countries of Albania, Andorra, Armenia, Austria, Azerbaijan, Belarus, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Georgia, Germany, Greece, Hungary, Iceland, Ireland, Italy, Kazakhstan, Kosovo, Latvia, Liechtenstein, Lithuania, Luxembourg, Macedonia, Malta, Moldova, Monaco, Montenegro, Netherlands, Norway, Poland, Portugal, Romania, Russia, San Marino, Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey, Ukraine, United Kingdom (UK), and Vatican City. BEING UNDERAGED AND PARTICIPATING IN A SERVICE THAT YOU DO NOT MEET THE REQUIREMENTS FOR MAY BE PUNISHABLE BY ACCOUNT DISABLING UNTIL THE USER'S 13TH OR (in special cases) 16TH BIRTHDAY. YOU AGREE BY REGISTERING TO OUR SERVICE THAT YOU ABIDE BY OUR RULES, POLICIES, AND THE LEGAL LAWS IN YOUR COUNTRY OR JURISDICTION. YOU ALSO AGREE THAT WE CAN SUSPEND OR TERMINATE YOUR ACCESS TO OUR SERVICE WITH OR WITHOUT WARNING.
By using our Services, you agree that you are in control of your profile, and while some information may be available to fill out, the information to fill out is optional, and you have the option to hide your email from the other members. We do not transmit this information to third parties, though we cannot control some sites that may publish information to the network. It is strongly recommended that you do not fill out details you are uncomfortable with others seeing. Information posted from outside websites is not in our control, and we cannot stop the information from being public viewing. Thus, your information you release in your profile may become "Public Information" as an example of the US law The Freedom of Information Act, 5 U.S.C. § 552.
We do not view The Freedom of Information Act on our Services meaning disclosure of information made by our Services to the public as in databases, IP addresses, or otherwise any information kept private. WE WILL SOMETIMES POST INFORMATION OR UPDATES AHEAD OF TIME SO THAT YOU ARE AWARE OF WHAT IS GOING ON. THIS IS MAINLY OUR FREEDOM OF INFORMATION ACT ON THESE SERVICES.
HOW OUR SERVICE AFFECTS YOU
Our Service can be misused by improper Administration, although the Webmaster conforms that the Administration are highly trusted, and are close friends with the Webmaster and has little to most experience with Administration. Properly trained, these Administration are willing to work with the community, its Users, and its Viewers to build a safe and fun experience.
Improper Administration is dealt with very harshly, and may result in loss of administrative privileges, as well as an account suspension. If you feel that you are seeing improper Administration, you should report it to our team, so we can handle it accordingly. In addition, you may access our forum community via Discord. You must conform and abide by Discord's Terms of Service which can be found here.
Misuse of the Discord function may conform to penalties via the warning system or an account suspension, depending on the severity.
CONTENT POSTED TO OUR FORUMS AND DCMA
Content posted to the forums are considered to be a limited license, allowing for images and/or videos to be posted using embed tools and for general viewing. Content posted onto our forums is "Your Content", (excluding copyrighted works) but partly "Our Property". You are granting us a non-exclusive license to reuse or make adjustments to your post, display your content publicly, store your content, or distribute to other members of the Service Administration. If you are the copyright holder and you would like your work to be taken down, please send a message to the Webmaster by contacting him: email@example.com. You may also talk to the team by contacting them: firstname.lastname@example.org. If you would like your work to remain off our forum, you may include that in the request of your takedown request. The user who submitted the content may not be punished depending on the circumstances, such as (i) the intentions of posting the copyrighted work, (ii) the copyrighted work amounts, and (iii) if such copyrighted work is determined to be significant in terms of the takedown request. An immediate takedown request will be considered as a normal takedown request, although both takedown requests will be considered for removal. You agree as the copyright holder to experience a delay as the team is small and does not actively check their messages 24/7. If you consider to take us to court over delays, your request may be legally denied, or you may be blacklisted from sending a request. By being blacklisted, you are permanently considered to be "Do Not Post as of Copyright Issues" and will be ineligible to allow your works on our forum.
If you would like your works to be allowed as a limited license along with your copyright takedown request, or a "Change in Copyright" request, you must include it with your message. Works that are "watermarked" are considered Copyrightable Content, meaning they have a source of the image and the source may determine what is responsible for the work that you submit onto our forum. This is considered to be our limited license.
Our Limited License is the following:
- You have, unless otherwise posted, permission to use the image in a license supported by the global licenses, such as a Creative Commons license.
- You may not assume credit for the copyrighted work, unless you are the copyright holder, which may be considered infringing copyright in your country or jurisdiction.
- You cannot, under any legal circumstances, claim that you have full permission of a copyrighted work, unless such circumstances are legally permissible by law.
- Depending on if the work is allowed through our Avoid Posting List, you may not post the copyrighted work which is traceable from reverse searching.
- If the copyright owner decides to cease the actions of allowing us on the Service to host their copyrighted work, this will be considered as a copyright strike for those who maliciously uploads the material to our site as a result of the public information.
If you, the copyright holder, intend to shut down the board as a result of the copyright takedown, we will discourage the need for a legal battle, since the content produced may be available publicly. We ask that you ask the original source to take down the content as well, since the public content usually used here can be traced to a more notable source.
OUR RULES AND POLICIES
Forum messages containing any of the rules being broken will be considered in violation of our Terms of Agreement and/or our Policies.
Content produced must be clean of sexual content, racially charged language, harassment (especially targeted), pointless advertising (though you may advertise some of your stuff on your profile), malware, viruses, or "surveys", content that aggravates, or otherwise offends a certain race, religion, or otherwise is determined "offensive" to a specific group, spam, and any IP logging sites. Links may point to appropriate communities, such as the following in our list: Roblox, Twitter, Twitch, Disqus (Appropriate Communities Only), Discord (avoid NSFW servers or servers with the NSFW functionality), YouTube (age restricted videos/channels are discouraged), Apple, and Google. Links to our forums is automatically approved, as it is part of what you're browsing here.
Edits: Facebook is considered by many to be unsafe in terms of data. We have removed Facebook after a close, personal review. Google+ and the Google Support Boards are merged into Google. Skype is discontinued, and also is very insecure since you can obtain IP Addresses, via "Skype Resolvers", and thus they have been removed.
By posting links, you agree to conform to our regulations and/or our policies, and that your use of those links may be governed by the host of the links that you have provided.
PERSONAL MESSAGING AND YOUR RIGHTS TO THEM
The "Personal Messaging" (PMing) option exists for members to have a more personal communication with a staff member or with another member. You may not post logs publicly. You can report the PM if you believe it breaks a rule, and we will review it.
You have every right, unless revoked, to communicate freely to a User or a member of the Administration with any topic or concern you may want to bring up. We do not recommend emailing as we do not check around often, unless you have a copyright claim you would like to bring to us.
You agree by using Personal Messaging that you conform to the regulations and/or the policies that are enforced, and that we have the right to suspend your uses for the Private Messaging if your account is deemed to be violating the rules.
You also reserve your right for necessary tracking or obtaining these messages from the Administration at sole discretion, and that you are allowing us to review these messages sent through our platform for quality, training, security, and activity purposes.
PROFILES AND YOUR RIGHTS
Your Profile may be edited at anytime as you feel, such as information that is available to modify. Though it is recommended not to fully expose yourself with details, you are in control of your personal information.
By uploading a profile picture, you conform to our Limited License policy and to the Copyright Takedown policy. Though this has rarely happened on boards, it is still a possibility. Furthermore, you also consent to your profile being visible on the forums as a result of your uploading, and in no way are others liable for your profile picture. Your account can face penalties if you upload content that is explicit or otherwise offensive. We store profile pictures in our Database and we can use those against you in a court of law.
StopForumSpam is integrated into our forums. By registering, you agree to be ran a background check towards sign up, posting, and editing your profile. The only way not to consent to it is to not register. You can find StopForumSpam onits official website.
If your IP is listed on the StopForumSpam (and we check quite frequently via WHOIS, not to obtain geographical locations), you will be on our watchlist. The Watchlist is only available to Staff, and will only be kept between our Staff. This is not to punish anyone, but to avoid significant spam onto our forums.
COPYRIGHTS AND TRADEMARKS
The emoticons are licensed under a CC 4.0 Attribution license. They are used from an open sourced project.
MyBB is a registered trademark and copyrighted by the MyBB Group. This is an open sourced board.
The Tails head is part of SEGA of America, and on good faith is not intended to be copyright infringement. We intend to use part of it as a logo, and in no way are we receiving profit from the logo. If SEGA of America would like us to change the material of it, we will comply with such request or order.
The Project Xyaena theme is STRICTLY our property. Even though KADOKAWA may own some of the content, we also have our rights to the data as well. Data posted onto the forums that involves our content, including from Project Xyaena, may be dealt with harsh consequences.
The Deadbullet logo is based from an image in the Public Domain, but is NOT in the Public Domain. Do not redistribute without permission.
Copyright infringement as part of leaking game data, any data that could be imported into an engine, commonly Unreal Engine®, any animation data, or even any texture or graphic that is part of a game in development or official that is posted onto our forums that does not follow our Limited License policies will be considered Copyright Infringement. Avoid posting them. Raw data is easy to be determined as Copyright Infringement. We will notify official companies of your infringement if we have to, leaving it between you and the company, avoiding us from facing legal issues and leaving us to be innocent of infringement.
REGARDS TO BUSINESS OR EDUCATIONAL ADDRESSES/SERVICES
You may be able to access the board using a business or school related IP. While strongly discouraged on our end, you will have to abide by the rules and policies set by the business or educational service in which your IP will be coming from. Failure to abide by such rules may result in your business or educational service blocking the site. We have already appealed to Lightspeed Systems once, only because they confused us with malware and security, in which we are neither of those. In addition, we cannot control what blocks are performed by your business or educational service, and we are not responsible for such actions. If your service requires us to perform an IP block to the service, we will do it. It's not for us to decide, it is a legal thing we must follow.
FAILURE TO CONFORM WITH YOUR LEGAL LAWS MAY RESULT IN CIVIL OR CRIMINAL PENALTIES. YOU ARE NOT TO HOLD US LIABLE FOR YOUR ACTIONS.
FAILURE TO CONFORM WITH THE POLICIES MAY RESULT IN THE SUSPENSION OR TERMINATION OF YOUR ACCOUNT AS NECESSARY IN THE TERMS OF AGREEMENT. YOU HAVE AGREED ONTO THESE TERMS AND THEREFORE WILL BE CONSIDERED, BY THE AGREEMENT OF THESE TERMS, TO BE FAIR IN ANY WAY AS LONG AS YOU HAVE AGREED TO OUR TERMS OF AGREEMENT.
You may use the Contact the Staff board to close your account, although we will keep some information available such as your post records. You cannot be contacted through PMs if you are closed. Furthermore, you cannot be allowed to create an account after you close your old account, as it can be considered abuse. Closing your account means you are leaving the boards for a long period of time. To temporarily (and with a good reason) close your account, you can use the same method along with a time frame of how long you want to be disabled. Your account's rank will remain the same when you are reactivated.
Welcome to the forums. You have reached the end of this Terms of Agreement. Keep in mind it can, and will, be updated as necessary.
